Welcome to Marker Media. By using our website and services, you agree to the following terms and conditions. Please read them carefully.

1. Introduction

These terms govern your use of Marker Media’s website and services. By accessing or using our site, you confirm that you accept these terms and agree to abide by them.

2. Services

Marker Media offers photography and videography services, including but not limited to:

• Brand and commercial photography
• Event coverage
• Portraits (studio and outdoor)
• Graduation photography
• Custom projects

Specific terms for services will be outlined in individual contracts.

3. Intellectual Property

All content on this website, including images, videos, text, and graphics, is the property of Marker Media unless otherwise stated. You may not reproduce, distribute, or use any content without explicit written permission.

4. Booking and Payment

• A deposit of 50% is required to confirm a booking. The remaining balance is due upon delivery of final content unless otherwise stated in your agreement.
• Bookings are subject to availability and are confirmed only after the deposit is received.
• Payments are accepted via EFT or other methods specified in the invoice.

5. Cancellations and Refunds

• Cancellations must be made at least 7 days prior to the scheduled shoot for a full refund of the deposit.
• Cancellations within 7 days will result in forfeiture of the deposit.
• Rescheduling is allowed subject to availability and must be done at least 48 hours before the shoot.
• If a Client cancels within 2-3 days of the event, the deposit is non-refundable. Cancellations made more than 3 days in advance will receive a 50% refund of the deposit.

6. Delivery of Content

• Edited images and videos will be delivered within the timeframe agreed upon in your contract.
• Final content will be delivered digitally unless otherwise agreed.
• Marker Media retains the right to use non-confidential client content for promotional purposes unless explicitly prohibited by the client.
• Raw images will not be provided unless explicitly agreed upon. An additional fee may apply for access to unedited files.
• Images will be stored for one year. After this period, Marker Media is not responsible for storage or archiving.

7. Client Responsibilities

Clients are responsible for ensuring that all necessary permissions and releases (e.g., property access, model releases) are obtained before the shoot. Marker Media is not liable for any delays or disruptions caused by the client’s failure to secure permissions.

8. Liability

Marker Media will not be held responsible for any loss, theft, or damage to personal property during the shoot. The Client is responsible for damages to the Photographer’s equipment caused by negligence. Marker Media’s liability for any claim related to our services will not exceed the fees paid for the specific service in question.

9. Privacy Policy

We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy for details on how we handle your data.

10. Amendments

Marker Media reserves the right to update or modify these terms at any time without prior notice. Changes will be effective immediately upon posting to our website.

11. Governing Law

These terms and conditions are governed by the laws of South Africa. Any disputes will be resolved in accordance with local jurisdiction.
